Stay of Execution Order to Prime Ministry’s Circular

Turkish 8th Chamber of Council of State ordered stay of execution for Prime Ministry’s Circular in terms of “mining licences”, that authorises Prime Ministry as the decision maker in exploration/mining licencing process; whereas the licences are normally obtained from Republic of Turkey Ministry of Energy and Natural Resources, General Directorate of Mineral Research & Exploration (MİGEM).

A person who applied for exploration licence in Zonguldak - Kozlu, brought an action in Council of State against the procedure of Social and Cultural Affairs Presidency of Turkish Prime Ministry for rejecting his application by using Prime Ministry’s Circular 2012/15 as base.

8th Chamber of Council of State stopped the execution of procedure with respect to rejection of exploration licence and the execution of Prime Ministry’s Circular in terms of “mining licences”. Therefore, arrangements of licences which is related to mining rights and following the mining activities in these licence areas, are assigned to MİGEM.

It was also reminded that “mining activities and licencing procedures could be imposed restriction by the Ministry, exploration activities are not subjected to permission except for the terms which are written in this law, and mining operations are executed in accordance with regulations of Ministry” according to Mining Law.  

Additionally, it was reminded that applications must be done to MİGEM, in order to obtain exploration licences in reference to The “Implementation Regulation for Mining Activities” was published in the Official Gazette dated November 6, 2010.
